1. Acceptance of Terms
By creating an account, accessing, or using StatStack (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years of age to use StatStack. If you are between 13 and 17, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In that case, "you" and "your" refer to the organization.
2. Description of Service
StatStack is an esports creator and talent management platform designed for esports organizations and teams. The Service operates as a multi-tenant SaaS application where each organization receives a dedicated subdomain (e.g., orgname.statstackhq.com).
Features provided by the Service include, but are not limited to:
- Creator and roster management with profile pages and social media links
- Multi-platform social media analytics (YouTube, Twitch, Twitter/X, TikTok, Instagram, Kick)
- Content production pipeline with kanban-style workflow management
- Event planning and management with checklists and stage tracking
- Twitter/X giveaway campaigns with automated winner selection
- Discord bot integration for notifications and slash commands
- AI-powered chatbot assistant (Stacky) for platform queries
- Media valuation estimates and ROI tracking
- Staff management with granular role-based permissions
The Service depends on third-party APIs and platforms (including but not limited to Twitter/X, YouTube, Twitch, TikTok, Instagram, Kick, Discord, and Anthropic) whose availability, terms, and data access policies are outside our control. Changes to these third-party services may affect the features and functionality available through StatStack.
3. Account Registration & Security
To use StatStack, you must create an account by providing an accurate organization name and a valid admin email address. You are responsible for maintaining the accuracy of your account information.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at security@statstackhq.com if you become aware of any unauthorized use of your account or any other security breach.
Each account corresponds to one organization. The organization admin is responsible for managing staff accounts, creator profiles, and all data associated with their organization's account.
4. Subscription Terms & Billing
StatStack offers the following subscription plans:
- StatStack Pro: $49 per month
- StatStack Organization: $149 per month
- Lifetime Access: $2,500 one-time payment
Both the Pro and Organization plans include a 14-day free trial. During the trial, you have full access to the plan's features. Your trial will automatically convert to a paid subscription at the end of the 14-day period unless you cancel before the trial ends.
All billing is processed through Stripe. By subscribing, you agree to Stripe's Terms of Service. StatStack does not store or have access to your payment card details.
Monthly subscriptions auto-renew on the same date each billing cycle. By subscribing, you authorize recurring charges to your payment method on file until you cancel.
We reserve the right to change subscription prices. We will provide at least 30 days written notice (via email) before any price increase takes effect. The new pricing will apply at the start of your next billing cycle following the notice period.
5. Cancellation & Refunds
You may cancel your subscription at any time through your organization's billing settings. Upon cancellation, you will retain access to the Service through the end of your current billing period. No further charges will be made after cancellation takes effect.
No prorated refunds are issued for partial billing periods. If you cancel mid-cycle, you retain access until the period ends, but no partial refund will be provided.
Lifetime Access purchases are non-refundable after 30 days from the date of purchase. Within the first 30 days, Lifetime Access purchases are eligible for a refund minus the value of any usage during that period.
Free trial cancellation: If you cancel before your 14-day trial ends, you will not be charged. No payment is collected during the trial period.
We reserve the right to issue refunds at our sole discretion on a case-by-case basis. Contact security@statstackhq.com for refund requests.
6. Acceptable Use
When using StatStack, you agree that you will not:
- Violate any applicable local, state, national, or international law or regulation
- Use the platform to harass, abuse, threaten, spam, or defraud any person
- Attempt to access, view, or modify data belonging to other organizations on the platform
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Scrape, crawl, or use automated tools to extract data from the Service beyond normal API usage
- Deliberately overload, disrupt, or degrade the performance of the Service
- Use the giveaway system to conduct illegal sweepstakes, lotteries, or gambling activities
- Upload malicious code, viruses, or use the platform to distribute malware
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity
Organization admins are responsible for ensuring they have proper consent from creators whose data they manage through the platform. This includes collecting and storing personal information, social media handles, contract details, and media assets.

7. Intellectual Property
StatStack's property: StatStack owns all rights, title, and interest in the platform code, design, branding, documentation, and infrastructure. This includes all software, visual design elements, trademarks, and proprietary technology that power the Service.
Your property: Organizations retain full ownership of their data, including creator profiles, content, analytics records, contracts, event data, and any other information uploaded to or generated within their organization account.
By using the Service, you grant StatStack a limited, non-exclusive, worldwide license to process, store, display, and transmit your data solely as needed to provide and improve the Service. This license terminates when you delete your data or close your account.
Creator-uploaded photos, logos, and media assets remain the property of the respective creators or organizations that uploaded them. StatStack claims no ownership over user-uploaded content.
"StatStack," the StatStack logo, and "Stacky" are trademarks of StatStack. You may not use these marks without prior written permission.
8. AI Chatbot (Stacky) Disclaimer
Stacky is an AI-powered assistant integrated into the StatStack platform. Stacky is powered by third-party AI models provided by Anthropic (Claude) and is designed to help you query your organization's data using natural language.
You acknowledge and agree that:
- AI-generated responses may be inaccurate, incomplete, or outdated
- You should independently verify any information provided by Stacky before making decisions based on it
- Conversations with Stacky may be logged for the purpose of improving the Service
- You should not share sensitive personal information (such as Social Security numbers, passwords, financial account numbers, or similar credentials) with the chatbot
- StatStack is not liable for any decisions made, actions taken, or losses incurred based on AI-generated content
9. Social Media Statistics Disclaimer
StatStack retrieves follower counts and social media statistics from third-party sources and APIs. You acknowledge and agree that:
- All statistics displayed are approximations and may not reflect exact real-time values
- We do not guarantee the accuracy, completeness, or timeliness of any statistics displayed on the platform
- Changes to third-party platform APIs, rate limits, or terms of service may affect data availability at any time
- Historical statistics represent point-in-time snapshots and may not match current counts on the source platforms
- Media valuation estimates are algorithmic approximations based on publicly available data and industry benchmarks; they are not guaranteed values and should not be solely relied upon for business decisions
10. Giveaway / Contest Terms
StatStack provides tools that enable organizations to run giveaway and contest campaigns through Twitter/X. By using the giveaway feature, you acknowledge and agree that:
- Organizations running giveaways are solely responsible for compliance with all applicable sweepstakes, contest, and promotion laws in their jurisdiction
- StatStack provides the technology tool; the organization assumes full legal responsibility for any giveaway or contest it runs
- Winner selection uses automated random selection algorithms; StatStack does not guarantee the fairness perception by third parties
- Organizations must ensure their giveaways comply with Twitter/X's contest and promotion rules
- StatStack is not a sponsor, co-sponsor, or administrator of any giveaway run through the platform unless explicitly stated otherwise
11. Data & Privacy
Our collection, use, and protection of data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
In the context of data protection, organization admins act as data controllers for the creator and staff data they manage through the platform. StatStack acts as a data processor on behalf of organizations, processing data only as necessary to provide the Service.

12. Service Availability & Modifications
We strive to maintain high availability of the Service, but we do not guarantee that StatStack will be available without interruption, error, or delay at all times.
We may modify, update, suspend, or discontinue any features or aspects of the Service with reasonable notice. Where practical, we will provide advance notice of significant changes.
Scheduled maintenance will be communicated in advance when possible through email notifications or in-platform announcements.
Third-party API outages or changes (including but not limited to Twitter/X, YouTube, Twitch, TikTok, Instagram, Kick, and Discord) may temporarily or permanently affect the functionality of certain features. StatStack is not liable for disruptions caused by third-party service changes.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STATSTACK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages, regardless of cause
- Any loss of profits, revenue, data, business opportunities, or goodwill
- Any damages arising from the use of or inability to use the Service
- Any damages arising from unauthorized access to or alteration of your data
IN NO EVENT SHALL STATSTACK'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO STATSTACK IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of the legal theory under which liability is sought, whether in contract, tort (including negligence), strict liability, warranty, or otherwise, and even if StatStack has been advised of the possibility of such damages.
14. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
StatStack expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Service will be uninterrupted, timely, secure, or error-free
- Any warranty regarding the accuracy, reliability, or completeness of any third-party data, including social media statistics, media valuations, or AI-generated responses
- Any warranty that defects will be corrected or that the Service is free of viruses or other harmful components
15. Indemnification
You agree to indemnify, defend, and hold harmless StatStack and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service or any activity under your account
- Your violation of these Terms or any applicable law or regulation
- Your violation of any rights of a third party, including intellectual property rights or privacy rights
- Any giveaway, contest, or promotion you run through the platform
- Any data you collect, store, or manage through the platform regarding creators or other individuals
- Any content you upload, submit, or transmit through the Service
16. Account Termination
By you: You may close your account at any time through your billing settings or by contacting us at security@statstackhq.com.
By StatStack: We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a security risk to the Service or other users. We may also terminate accounts for non-payment after providing reasonable notice.
Effect of termination: Upon termination, your access to the Service will cease immediately. Your organization's data will be retained for 30 days following termination, after which it will be permanently deleted. During this 30-day window, you may request a data export by contacting us.
The following provisions survive termination of these Terms: Limitation of Liability (Section 13), Warranty Disclaimer (Section 14), Indemnification (Section 15), Dispute Resolution (Section 17), and any other provisions that by their nature should survive.
17. Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Kansas, United States of America, without regard to its conflict of law provisions.
Informal resolution: Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at security@statstackhq.com. We will attempt to resolve the dispute through good-faith negotiation for a period of 30 days.
Binding arbitration: If the dispute is not resolved informally within 30 days, it shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association. The arbitration shall be held in Kansas, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
Class action waiver: You agree to resolve disputes with StatStack on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.
Small claims court: Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
18. General Provisions
Entire agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and StatStack regarding the Service and supersede all prior agreements and understandings.
Waiver: Our failure to enforce any provision of these Terms at any time does not waive our right to enforce that provision or any other provision in the future.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Assignment: StatStack may assign or transfer its rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations without our prior written consent.
Notices: We may send notices to you via the email address associated with your account or through in-platform notifications. Notices to StatStack should be sent to security@statstackhq.com.
19. Changes to Terms
We may update these Terms from time to time to reflect changes in our Service, business practices, or legal requirements.
For material changes, we will provide at least 30 days notice via email before the changes take effect. We may also post a notice within the platform.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service before the changes take effect.
